As I write this, former Indian pacer S.Sreesanth is probably rejoicing, after the lifetime ban handed to him by the BCCI for spot-fixing in the IPL, was quashed by the Kerala High Court few days back. The most common reaction regarding this development is regarding the chances of him making a comeback to international cricket or at least on the domestic circuit. BCCI’s silent reaction to this Court verdict more or less sums up the future for Sreesanth. In India, the legal system has a set protocol to it but along with that, a few loopholes as well.
The Kerala High Court’s verdict was based on the fact that the charges against Sreesanth in the 2013 IPL spot-fixing fiasco were dropped by a trial court in Delhi back in 2015. That ruling came due to the lack of evidence from the Delhi Police’s side to prove that the former Indian star had been involved in criminal activities. The word ‘criminal’ is of utmost significance here because despite all the corruption that spot fixing refers to, it isn’t a crime according to the legal system in India. Yes, as a sports body, BCCI can punish the player and that’s what it has done but such charges wouldn’t stand in the court simply because it wasn’t legally speaking, a criminal offence.
