OFFERING a chair to an older work colleague could count as age discrimination, according to an employment tribunal judge.
The ruling came in the case of a 66-year-old recycling plant operative who sued for discrimination after his boss asked him if he wanted to sit down during his shift.
Filipe Edreira - who believed his employers were trying to force him out claimed he was being singled out as no one else used chairs.
Mr Edreira worked for Severn Waste Services, in Worcester, from 2006 until he was sacked in 2023, the Birmingham tribunal heard.
Now 68, he believed that he was offered a seat as part of the company's aim to get him to leave because he had reached the age of 66.
Later, he was wrongly accused of taking unauthorised absence from work. The same month he went off sick and he was subsequently sacked.
His case was rejected but the tribunal agreed that the offer of a seat was "unwanted conduct" that could have been discriminatory.
